Do I need a lawyer to file for divorce?

In Colorado, you absolutely can file a divorce yourself. you can go to the Colorado Supreme Court website and go to the forms section. In the forms section go to family law forms, and under family law forms you will file a petition for dissolution of marriage. All the other forms that would be necessary for you to file divorce for yourself can be found here as well.

The only problem with filing a divorce for yourself is if you run into situations where you have to be in court and you don’t know how to navigate the court system. That can be extremely frustrating for people especially if there’s a lawyer on the other side, but if you and your soon-to-be ex-spouse are congenial with one another and want to fill out the forms and agree to things, you certainly could go through the divorce process on your own. I certainly know a lot of people that have done that.

You have to be willing to dig in and feel somewhat uncomfortable with forms that you don’t understand. The other option that you have is you can work with a law firm like ourselves, where we consult with you and then rather than paying an attorney to do it all for you, you pay an attorney to spend an hour or two here and there to help. A divorce attorney can help you with the forms, help you move forward in the case, and give you advice on how to fill things out, but not actually enter as your attorney. That’s sort of a middle-of-the-road option that I think has really benefited a lot of people that orally didn’t have a case where they needed a full-fledged lawyer. For more information about filing for divorce, how divorce works, or any other family law matters in Colorado, call us at 303-329-3802.
